These Terms of Service ("Terms") govern your access to and use of Proof & Purchase (the "Service"). By using the Service, you agree to be bound by these Terms.
Eligibility
You must be at least 18 years old to use the Service.
Your account
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information.
Account inactivity
We reserve the right to delete inactive free tier accounts at our discretion to manage platform resources. An account may be considered inactive if there has been no login activity for an extended period. Before any account deletion, we will notify you via email at the address associated with your account at least 28 days in advance, giving you the opportunity to log in and retain your account. Paid subscription accounts are not subject to deletion due to inactivity while the subscription remains active.
Using the Service
- Clients can check out as guests via Stripe. No client account is required.
- You agree not to misuse the Service or attempt to access it in unauthorized ways.
- You will comply with all applicable laws and regulations.
Subscriptions and fees
- Paid plans are billed in advance on a recurring basis as described at checkout.
- Transaction fees apply to sales processed through the Service.
- Stripe may charge additional processing fees based on your agreement with Stripe.
- Fees are non-refundable except where required by law.
Your content
- You retain ownership of the photos and content you upload.
- You grant Proof & Purchase a limited license to host, process, and display your content to operate the Service.
- You represent that you have the rights needed to upload and share the content.
Prohibited content and conduct
- Infringing, unlawful, or harmful content.
- Malware, phishing, or attempts to disrupt the Service.
- Harassment, abuse, or violations of privacy rights.
Third-party services
The Service integrates with third-party services such as Stripe. Your use of those services is governed by their own terms and policies.
Availability and changes
We may modify, suspend, or discontinue the Service at any time. We are not liable for any interruption or loss of functionality.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service.
Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
Limitation of liability
To the fullest extent permitted by law, Proof & Purchase will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Indemnification
You agree to indemnify and hold harmless Proof & Purchase from any claims or liabilities arising from your use of the Service or your content.
Governing law
These Terms are governed by the laws of the jurisdiction in which Proof & Purchase is established, without regard to conflict of law rules.
Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date.
